政府意志与征地利益冲突

[摘要]我国农地产权制度变迁过程中蕴含的政府意志并不必然导致征地利益冲突，但在以下四个基本条件具备时，政府意志就容易导致征地利益冲突：1、政府意志导致征地利益冲突的“公共利益至上借口”条件；2、政府意志导致征地利益冲突的“农地产权变迁逻辑”条件；3、政府意志导致征地利益冲突的“村委会双重角色”条件；4、政府意志导致征地利益冲突的“农地公有产权特性”条件。第一个条件为地方政府侵害被征地村民利益提供了“形式上”的合法性；第二个条件为地方政府侵害被征地村民利益提供了“逻辑上”的合理性；第三个条件为地方政府侵害被征地村民利益提供了“操作上”的可行性；第四个条件为地方政府侵害被征地村民利益提供了“过程上”的安全性。

The Government’s Will and the Interest Conflicts in Rural Land Expropriation:an angle of Chinese Rural Land Property System

ABSTRACT:The interest conflicts in some areas’ land expropriation have close relations with Chinese rural land property system.The government’s will in the evolution of the Chinese rural land property system may result in the interest conflicts in land expropriation,if the four conditions below are satisfied: the excuse of “sacred public interest”;the logic for the change of the rural land property system;the dual role of the villagers’ committee;the characteristic of the collectivity-owned rural land property.The first two conditions supply the validity and rationality for the local government to impair the interest of the land-expropriated villagers.The third condition supply the feasibility for the local government to impair the interest of the land-expropriated villagers.The fourth one sweep off the obstacle from the common villager group’s collective actions.
