前在北京举办的“劳务派遣新规下的用工转型”座谈会上,国际领先的人力资本管理解决方案供应商ADP方面的专家指出,在劳务派遣受限的情况下,HRO(人力资源外包)将成为新的用工模式并成为企业人力资源管理发展的未来趋势。
新《劳动合同法》规定,劳务派遣用工最高比例为10%,这让很多企业头疼。数据显示,全国劳务派遣用工数量为3700万人。企业劳务派遣用工在遭遇新规的限制下,面临着前所未有的转型压力。ADP方面相关人士介绍,劳务派遣不与用人单位直接签订劳动合同,而是与第三方派遣机构签订合同,形成了“招人不管人,管人不招人”的特殊劳动关系,这给企业管理员工带来不便。而人力资源外包则不同,虽然员工与用人单位直接签订合同,但却把人员薪资、福利、税务、社保等工作外包给专业公司管理,这有效地帮助企业降低成本、提高效率。对于将如何劳务派遣用工平稳地转换成服务外包,前述人士介绍,转移流程由企业到ADP。在企业阶段,需要经过内部沟通,签订劳动合同变更三方协议书,即企业、员工和外包公司,然后再与员工签订劳动合同;ADP阶段,开立公司社保账户和公司公积金账户;最后完成员工个人账户转移以及日常月度变更。
Westmoreland commissioners Charles Anderson and Tyler Courtney on Thursday turned over control of the county human resources department to a private company that they said will save taxpayers up to $140,000 annually.
Opponents said the deal, which will pay Felice and Associates of Greensburg $216,000 a year, may not produce any savings.
“This deal was not properly vetted. We received no other proposals, and it was not proved this is a better deal than having an in-house director,” Commissioner Ted Kopas said.
The minority Democrat commissioner cast the lone dissenting vote.
Anderson and Courtney said the firm will modernize the personnel office, which oversees 2,000 employees and labor negotiations with 11 bargaining units.
John Felice, the company's owner, did not return several telephone calls seeking comment.
The firm will save money by reducing legal fees and securing additional reimbursements from the state and federal governments, according to Anderson and Courtney. But other officials said those reimbursements are being received for personnel services the county provides under state and federal grants.
The Felice company is being paid an additional $90,000 to analyze the county's nonunion workforce. The firm's $2,000 monthly retainer will be halted in February.
The Felice contract differs slightly from a four-year proposal revealed earlier this week. Commissioners approved a one-year deal, with three, one-year options allowing for the contract to end. If the company is retained all four years, the county will pay $864,000.
A company employee will serve as the human resources director. Anderson said office staff will remain on the job for now.
“We're not hiring a person. We're hiring a system. The people in there now will be evaluated, and there might be reassignments. This is a process,” Anderson said.
Under the contract, Felice and Associates will:
• Review and reorganize the human resources department.
• Update personnel policies.
• Update employee handbooks.
• Connect the human resources department to the county's computer system.
• Develop performance evaluation plans for nonunion workers.
• Implement financial analysis for labor negotiations.
• Develop consistent benefits for all unions.
• Develop management training programs.
Courtney said a study of the human resources department revealed deficiencies. “This has been a process going on for two years,” Courtney said.
Republican Controller Jeff Balzer told commissioners before the vote that the Felice contract was too costly. Balzer sought a three-month delay so additional options could be explored. Kopas' motion to table the action failed.
