Cambodia tribunal clears way for genocide trial
柬埔寨法庭为种族灭绝大屠杀审判铺路
A United Nations-assisted tribunal on Wednesdaycleared the way to begin the genocide trial of two elderly former top leaders ofCambodia's 1970s Khmer Rouge regime. Survivors of the communist regime's reignof terror, along with students and Buddhist monks, attended a hearing that laiddown the ground rules for the trial, which judges said would likely start inSeptember or October.

The defendants, Khieu Samphan, 83, and Nuon Chea,88, were in the top leadership of the 1975-79 regime, which is generally heldresponsible for the deaths of about 1.7 million people from starvation,exhaustion, disease and execution. The two are scheduled to hear the verdictnext week of a first trial against them for war crimes and crimes againsthumanity, related mostly to the forced movement of millions of people to thecountryside when the Khmer Rouge took power.

At Wednesday's hearing, the chief judge, Nil Nonn,read out the new charges before lawyers began debating witness lists,reparations requests and procedural objections. Khieu Samphan attended thehearing and appeared to be in good health, at times taking notes. Nuon Chea,however, remained in his holding cell because he is unable to sit for longperiods of time.

Because of the advanced age and poor health of thedefendants, the case against them has been divided into separate trials, inhopes that they will live long enough to have some judgments against them completed.Legal experts and lawyers have argued that such an approach muddies the pursuitof justice. Anta Guisse, a lawyer for Khieu Samphan, said she was concerned herclient would not get a fair trial amid confusion over what evidence or findingsfrom the first trial would be carried over into the upcoming one.

Among the scores of proposed witnesses, lawyers forNuon Chea urged the court to consider calling three senior members ofCambodia's current government: National Assembly President Heng Samrin, SenatePresident Chea Sim and Sen. Ouk Bunchoeun. All three served as high-rankingcadres before defecting from the Khmer Rouge and aiding in its overthrow.Long-serving current Prime Minister Hun Sen also was a Khmer Rouge defector.Previous efforts by the defense to have members of the government testify havestoked political tensions and been shot down.
在多名提出的证人中，谢农的辩护律师呼吁法庭考虑传唤国民议会议长韩桑林、参议院议长谢辛和参议员欧布琼等三位柬埔寨现任高层官员。这三人曾是红色高棉干部，但后来叛变并协助推翻该政权。上台许久的现任总理韩森也曾是红色高棉的叛徒。辩方先前要求ZF官员出庭作证的努力，曾煽动政治紧张并且遭到否决。
